Legal
Terms & Conditions
Please review with your own legal advisor before relying on these terms.
1. The seller and these terms
Scan Dishes is operated by ScanDishes ("we", "us", "the seller"). By creating an account or continuing to use the service, you agree to these terms and enter a contract with ScanDishes.
2. The service
Scan Dishes provides digital menus, a permanent QR code and, on the Pro plan, an order-receiving system for restaurants. We do not process payments for food; customers pay the restaurant directly.
3. Accounts
You must be of legal age or have authority to bind your organisation. You are responsible for keeping your account credentials confidential, for all activity under your account, and for all content you publish, including dish names, prices, photos and allergen information. You must provide accurate information and keep it updated.
4. Payments and subscriptions
Our order process is conducted by our online reseller Paddle.com. Paddle.com is the Merchant of Record for all our orders. Paddle provides all customer service inquiries and handles returns. Payment, billing, tax, cancellation and refund mechanics are governed by Paddle's Buyer Terms and our Refund Policy. Plans and trial terms are described on the Pricing page.
5. Licence and restrictions
We grant you a limited, non-exclusive, non-transferable right to use the service within your selected plan. You may not reverse engineer the service, resell or redistribute it, or circumvent technical limits.
6. Acceptable use
- No unlawful, misleading, fraudulent or infringing content, and no spam.
- No attempts to access other restaurants' data, probe our systems, introduce malware, or scrape the service.
- No abuse of the trial or affiliate program.
7. Intellectual property
We retain all ownership of the service and its intellectual property, including the software, documentation and branding. You retain ownership of your menu content; you grant us a limited licence to host and process it solely to provide the service.
8. Service level
The service is provided "as is". We do not guarantee uninterrupted or error-free performance, and we disclaim all implied warranties to the fullest extent permitted by law.
9. Data retention
Detailed orders are deleted automatically 24 hours after creation. Aggregate daily totals are kept for reporting. Menu data is kept while your account exists, even if a subscription expires.
10. Suspension and termination
We may suspend or terminate your access for material breach of these terms, non-payment, security or fraud risk, or repeated or serious policy violations. When access ends, your menu data is retained so you can export or return, and detailed orders are deleted on the schedule above.
11. Liability
To the extent permitted by law, we are not liable for indirect, consequential or special damages (including loss of profits, data or goodwill), and our aggregate liability is capped at the fees you paid in the 12 months before the claim. Nothing excludes liability for fraud, death or personal injury where the law requires it.
12. Changes
We may update these terms and will notify you of material changes. Continued use after a change means you accept the updated terms.
